INTEGRAL PRIVACY NOTICE

The Municipality of Querétaro, located at Boulevard Bernardo Quintana, number 10,000, Centro Cívico building, Centro Sur neighborhood, in the city of Santiago de Querétaro, Municipality of Querétaro, State of Querétaro, postal code 76090, through the Municipal Secretariat of Tourism, is responsible for the processing of the personal data you provide during the use of the webapp “Querétaro La Capital se vive, audioguía.” Such data will be safeguarded and protected in accordance with the provisions of the Political Constitution of the United Mexican States, the General Law on the Protection of Personal Data Held by Obligated Subjects, the General Law on Transparency and Access to Public Information, the Law on the Protection of Personal Data Held by Obligated Subjects of the State of Querétaro, and the Law on Transparency and Access to Public Information of the State of Querétaro.

The personal data collected are:

  • Name
  • Mobile phone number
  • Email address
  • Address

Sensitive personal data collected:

No sensitive personal data is collected in this processing.

The data will be used for the following purposes:

  • To verify, through the registration of individuals, participation and use of the webapp;
  • To prepare reports on compliance with quantitative goals and objectives of annual programs or operational plans, specifying that the reports generated will not link statistical information to data that could identify their holders;
  • To establish communication in order to notify or inform about any changes;
  • To preserve documentary records as part of the administrative archive; and
  • For statistical purposes, subjecting your data to a prior dissociation procedure, so that the statistics generated do not link general information to data that could identify their holders.

None of the previously stated purposes require your consent, as they relate to the use of a webapp containing information inherent to the Municipality of Querétaro, in accordance with Articles 16, sections I and V, and 24, section III, of the Law on the Protection of Personal Data Held by Obligated Subjects of the State of Querétaro, as well as Article 17, section IX, of the Law on Transparency and Access to Public Information of the State of Querétaro.

Disclosure and transfer of personal data

No disclosure or transfer of your personal data will be carried out as part of this processing, except if any of the situations described in Articles 16, 64, and 65 of the Law on the Protection of Personal Data Held by Obligated Subjects of the State of Querétaro occur, or the similar Articles 16, 60, and 64 of the General Law on the Protection of Personal Data Held by Obligated Subjects, in which cases your consent is not required.

Legal basis for the processing of personal data

In accordance with Article 6, subsection (a), section V, of the Political Constitution of the United Mexican States, the legal basis for the processing of personal data includes: Articles 6, Section A, and 16, second paragraph, of the Political Constitution of the United Mexican States; Articles 10, 11, 12, 16, 27, 37, and 78 of the Law on the Protection of Personal Data Held by Obligated Subjects of the State of Querétaro; Articles 62, 111, 115, and 119 of the Law on Transparency and Access to Public Information of the State of Querétaro. Likewise, based on the Regulations of the Secretariat of Tourism of the Municipality of Querétaro, Articles 7, section X, and Article 14, section X (published on February 25, 2025).

Exercise of ARCO Rights

You may exercise your rights of access, rectification, cancellation, or opposition of your personal data (ARCO rights) before the Transparency and Public Information Access Unit of the Municipality of Querétaro, through a written request, by email addressed to u.transparencia@municipiodequeretaro.gob.mx with the subject “Request for the exercise of ARCO rights,” or through the National Transparency Platform (https://www.plataformadetransparencia.org.mx), creating your account and entering the “Requests” section, under the option “Personal data request.”

The requirements for submitting such a request are as follows:

  1. a) For an individual: name of the personal data holder;
    b) For an individual represented by a legal proxy: name of the holder and the proxy;
  2. Address or means to receive notifications (email or phone number);
  3. Documents that prove the identity and legal capacity of the holder and, if applicable, the legal proxy;
  4. (Optional) The department responsible for processing the personal data and to whom the request is addressed;
  5. A clear and precise description of the personal data for which any ARCO right is being exercised, which is optional in the case of the access right;
  6. A description of the ARCO right you wish to exercise, or what you are requesting, and additionally:
    • When requesting access to personal data, you must indicate the preferred method of reproduction;
    • When requesting opposition, you must state the legitimate reasons or specific situation that motivates it, as well as the harm that the continued processing would cause, or the specific purposes to which you object;
    • When requesting cancellation, you must indicate the reasons for the request;
  7. Any additional element or document that facilitates the location of the personal data, when applicable.

For the right of access, the information may be reproduced in the following formats: digital media (compact disc, email, or mass storage device—USB—provided by the requester), simple copy, and certified copy.

Likewise, you are informed that the Municipality of Querétaro will have a period of three business days from the date of submission to declare its lack of jurisdiction regarding the request; a period of five business days to, if applicable, require compliance with any previously stated requirements, and to inform you of the existence of a specific procedure applicable to your request; and a period of 20 business days to issue a response indicating whether your request is accepted or rejected. If your request is accepted, an additional 15 business days will be available to fulfill the requested right, in accordance with Articles 38, 39, 40, 41, 43, 45, 46, 47, 48, and 49 of the Law on the Protection of Personal Data Held by Obligated Subjects of the State of Querétaro.

Finally, you are informed that a request for review may be filed against the response to your ARCO rights request, pursuant to Article 84 of the Law on the Protection of Personal Data Held by Obligated Subjects of the State of Querétaro.

Data Portability

It is specified that the personal data collected are not processed in an accessible and machine-readable electronic format that would allow their reuse and/or interoperability with other systems, in accordance with Article 51 of the Law on the Protection of Personal Data Held by Obligated Subjects of the State of Querétaro. Therefore, it is not possible to provide a copy of the personal data in such a format or transfer it to another data controller.
